Even if the crime is terrible, it's a cornerstone of our society that the perpetrator get a fair trial. But to get that trial, clear evidence of the perpetrator's guilt has to be presented. This paper discusses the way in which police and the judiciary cooperate to make certain that the evidence presented at trial is admissible.
Discussion
When a crime is committed, the police investigate; they try to preserve evidence which will be used in the prosecution of the case (Section II the criminal justice system). The police not only collect evidence, they have a duty to make arrests and "file a case against the arrested suspect" (Section II). While they are at the crime scene, "the police will generally take photographs, and confiscate materials, objects, and personal effects that
might aid in the investigation" (Section II). Family members who want personal effects returned to them...
