BY USING OR PLACING AN ORDER THROUGH WRITEMYESSAY.COM, YOU SIGNIFY ELECTRONICALLY YOUR AGREEMENT TO THESE TERMS OF SERVICE ("AGREEMENT" or "TERMS"), AND ARE AGREEING TO BE LEGALLY BOUND BY THEM.

This Agreement is subject to change by WriteMyEssay.com at any time; therefore, you are responsible to review these terms regularly to learn about any changes. Your ongoing use of WriteMyEssay.com after we post changes to this agreement means that you accept the new terms. This agreement is governed by the laws of the State of California and you hereby irrevocably consent to the exclusive jurisdiction and venue of the courts in Los Angeles County, California U.S.A. in all disputes arising out of or relating to the use of WriteMyEssay.com's services.

1. Legal definitions

"You" as referred to in this Agreement shall mean: the entity or person who access or uses the Site as an end user.

"Paper(s)" means any customized, sample research paper created and licensed by us to our customers as part of our services.

"Services" means collectively WriteMyEssay.com, its Web sites, applications, services, content, materials, software, and Papers.

"We" or "us" in this Agreement shall mean the providers of the Services, including without limitation, The Paper Database, Inc. and The Paper Store Enterprise, Inc. and their affiliates.

2. Description of services.

WriteMyEssay.com is an online service that offers members access to its research database and content, and personalized research. We offer the Services for informational, educational, and entertainment purposes only. You may use WriteMyEssay.com only for personal and lawful purposes.

3. Eligibility.

In order to use the Service or to place an order, you must (a) provide true, complete and up-to-date registration information about yourself, (b) agree to abide by these Terms and (c) provide a valid method of payment for any purchases. You must be legally capable to enter into contracts. We reserve the right to refuse service or to terminate accounts for any user and to change eligibility requirements at any time. You will need to establish a login account to access and use the Services. We may refuse the use of any login that we determine is unacceptable. Only one user is permitted per login and membership account.

4. Placement of Orders for Papers.

The information you submit for an order for a Paper will be reviewed by one of our representatives within minutes of receiving your order. Incomplete order forms will not be answered. No order is "final" until it has been approved by one of our representatives and you have been contacted via e-mail or telephone for confirmation. We will not charge your credit card until we have approved your order. By completing our order form, you are authorizing The Paper Store Enterprises, Inc. to commence the research and preparation of the described Paper using the medium for transmission that you requested and charging you according to the price schedule advertised.

5. Payment and Fees.

You agree to pay all fees and charges that you incur subject to the payment terms that will be disclosed to you at the time you make your purchase. When you make a purchase from us, you must provide us with a payment method. You must be authorized to use the payment method. You authorize us to charge you for the service using your payment method. You will pay service charges in advance. You agree that "The Paper Store Enterprises" will appear on your credit card, bank statement, or phone bill as the merchant of record for all purchases made by you. You hereby further authorize us to charge your chosen payment method for any and all additional purchases you may make from us. You will receive an email receipt for any purchase. Refunds are not granted under any circumstance once we have commenced work on any Paper or Services for you. Should a refund be issued by us, all refunds will be credited solely to the payment method used in the original transaction. We will not issue refunds by cash, check, or to another credit card or payment mechanism.

6. Ownership rights.

The Services are protected by copyright and other intellectual property laws and treaties. The Services are owned by us or by third parties who license such Services to us. You agree that any Paper will provide to is an original work of authorship created by us, owned by us, and is licensed to use only to use as a model paper for research only. You agree that any order you submit to us for a Paper or other Services shall not be deemed a "work made for hire" or commissioned work. We reserve all rights in the Services not specifically granted to you. You may not reverse engineer, decompile, or disassemble as aspect of the Services. You may not modify, adapt, or create derivative works from the Services. Do not help any one else to do any of the things prohibited in this paragraph.

7. We are not obligated for content provided by others.

The research materials and other content offered on the Services are provided "as is" by others and made available for research, reference, informational and entertainment purposes only. We are not liable for content or materials that are prepared by, posted or provided by others and by our advertisers. We are not responsible for content on the Internet. We reserve the right to remove content from the Services for any reason, but we are not responsible for any failure or delay in removing such material.

8. Authorization of Use.

The Services (including any Papers) provided by us are licensed, not sold. Provided that you are in full compliance with these Terms, we grant you (a) a single login to access to the Services and (b) a personal, limited, non-assignable and non-transferable license to use Services for example and research purposes only. You may store a copy of any Paper ordered and licensed to you on a single computer. You may not directly copy or redistribute any Paper in any form, including, for the purposes of purporting to distribute or turn in the Paper as an original work by you. We do not endorse nor tolerate any form of plagiarism and will not engage in any activity that facilitates cheating. No material within the Services may be transferred to any other person or entity, whether commercial or non-commercial. Except as expressly authorized by us, you may not otherwise copy, transmit, display, transfer, sell, sublicense, assign or distribute any materials from the Services.

We may in our reasonable discretion terminate your access to the Services at any time if the terms of this Agreement are breached. In the case that the terms are breached, you will be required to immediately destroy any information or material printed, downloaded or otherwise copied from the site.

9. Login Credentials.

You agree to keep your login credentials strictly confidential. You may not share your login credentials with anyone else, or allow other users to access the Services through your account. You are responsible for all activities and liability under your account. Unauthorized access to the Services is a breach of this Agreement and a violation of law. You understand and agree that we may track through the use of special software each subscriber's entry to the Services to ensure compliance with these Terms.

You agree to assume the responsibility to notify us immediately if any breach of security, theft or loss of login, or unauthorized disclosure of login information occurs. You will remain liable for unauthorized use of the Services until we are notified of the security breach by email or telephone.

10. Usage Rules.

You must comply with all laws and these Terms. You may not violate the rights of others. You may not engaged in any conduct that (a) constitutes plagiarism, academic fraud or dishonesty; (b) is fraudulent; (c) violates or infringes the rights of others, including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights; (d) impersonates any person, business or entity, including our employees and agents; (e) encourages conduct that would constitute a criminal offense or that gives rise to civil liability; (f) violates this Agreement; or (g) interferes with the use of the Services by others.

11. No Spam.

You may not harvest information about our users for the purpose of sending, or to facilitate the sending, of unsolicited bulk communications. We may terminate your membership and access to the Services immediately and take any other legal action if you, or anyone using your login violates these provisions.

12. Submissions.

We may use any comments, suggestions, complaints or other feedback you provide to us regarding the Services in any manner whatsoever for no compensation, attribution and without limitation of any kind.

13. Cancellation

We may cancel or terminate your access or account at any time in our sole discretion, although we will deliver any Paper ordered by you in accordance with these Terms provided that you are in full compliance with this Agreement. You are liable for charges incurred by you until termination of service. You are responsible for any charges imposed by your credit card issuing bank for exceeding your account limits or overdrawing your account.

14. Privacy Policy.

15. Advertisements.

Our Services may from time to time be supported by advertising revenue and that such advertisements may be targeted to the content of information. As consideration for your use of the Services, you consent to our placements of such advertising.

16. International Use.

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside. You must comply with all local laws within the territories that you access the Services.

17. LIMITED WARRANTY AND DISCLAIMER OF WARRANTIES.

  1. Limited Warranty. We will use commercially reasonable efforts to make sure all Papers will reasonably match instructions provided by our customers. If a research-related parameter is ignored in a Paper, The Paper Store Enterprises, Inc. will revise the work performed within 2 days or, within 1 day if the customer's original request was for an emergency rush. We will use commercially reasonable efforts to complete delivery of a paper by sunrise (Pacific Standard Time) following the agreed-upon date for delivery. You agree that we will not be responsible for delivery failures that are not caused by us or are outside our control. For example, we are not responsible if your e-mail server is down, or if your fax machine isn't working, or if your local carrier doesn't deliver on-time, and under such circumstances, you remain responsible for your payment obligations under these Terms. If you call us after the Paper was due because you have not yet received it through the medium you requested, we will promptly re-send it that day through any other medium.
  2. Warranty Disclaimers. Except as otherwise provided above, we offer the Services "as-is," "with all faults" and "as available." We do not guarantee the accuracy or timeliness of the Services. WE GIVE NO EXPRESS WARRANTIES, GUARANTEES OR CONDITIONS. WE DISCLAIM ANY IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT AND NON-INFRINGEMENT. WE MAKE NO REPRESENTATIONS OR GUARANTEES THAT THE SERVICES WILL MEET YOUR REQUIREMENTS. YOU ARE USING THE SERVICES ENTIRELY AT YOUR OWN RISK.

18. LIABILITY LIMITATION.

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US OR YOUR USE OF THE SERVICES IS TO DISCONTINUE YOUR USE OF THE SERVICE. WE, OUR OWNERS, EMPLOYEES, REPRESENTATIVES AND AGENTS, SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF, INABILITY TO USE, OR RELIANCE UPON YOUR USE OF THE SERVICES, EVEN IF WE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS RELATING TO THE USE OF THE SERVICES EXCEED THE TOTAL AMOUNT OF SERVICE FEES THAT YOU PAID FOR THE SPECIFIC PAPER AND ORDER AT ISSUE.

19. Release, Indemnity.

By availing yourself of your use of the Services, you agree to release and hold us and our employees, officers, directors, shareholders, agents, representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, any third-party providers or sources of information or data and legal advisers harmless from any and all losses, damages, rights, claims, and actions of any kind arising from or related to your use or misuse of the Services.

20. Notice.

You understand and agree that we transact with our users electronically and, therefore, we may provide you with required notices and terms electronically, either by sending you an e-mail to the address that you have provided to us, or by posting a notice on the appropriate Web page. By using the Services or registering with us, you represent that you have the necessary equipment, software and internet access to read, review, print and store any terms or notices that we provide to you.

21. General Terms.

These terms make up the entire agreement between you and us regarding your use of the Services. We may assign this contract, in whole or in part, at any time, with or without notice to you. You may not assign this contract, or any part of it, to any other person.
